Rates published by CityNation Publishing
are current until otherwise noted, which shall not affect existing advertising
contracts. Announcements of any changes in rates will be made upon 30 days notice to
advertisers.
CityNation Publishing is not responsible for errors or omissions in any links
and advertising materials.
CityNation Publishing shall not be subject to any liability for any
failure to provide reference or access to all or any part of the links or advertising
due to systems failures or any other technological failures of CityNation Publishing,
its agencies, Internet providers, or the Internet.
No conditions, printed or otherwise,
appearing on contracts, insertion orders, order blanks or instructions which conflict with
the provisions of these terms and conditions or on our rate card will be binding on CityNation Publishing. Except as
otherwise specifically agreed by CityNation Publishing, all links and advertisement positioning/placement conditions will be
treated as requests only and cannot be guaranteed.
If an advertising contract or order is
not fulfilled in any way, the rate charged will be adjusted within sixty days. Nonpayment
of invoices may result in the termination of an advertising. Notwithstanding, the standard
rate for furnished advertisements is due and payable upon receipt of the invoice.
Publication of an advertisement shall
constitute acceptance of the advertiser's order. CityNation Publishing shall in no event be liable for failure to publish links
and advertising. However, if no advertising is published any charges therefrom received by
the publisher shall be refunded.
Advertising agencies are responsible for
payment of all advertising ordered on behalf of their clients, unless otherwise indicated
in writing to CityNation Publishing. CityNation Publishing reserves the right to hold the agency and the advertiser jointly and
severally liable for all such payments.
Unless otherwise agreed by CityNation Publishing and the
advertiser, CityNation Publishing shall have the right to insert the submitted article or advertising
in various areas of CityNation Publishing publications from time to time at its discretion.
Advertiser acknowledges that it is
generally familiar with the nature of the Web and proposed uses thereof.
CityNation Publishing reserves the right to reject or cancel any requested links or
advertising and/or linkage to an advertiser's site on the Web for any reason at any time,
including without limitation as a result of linkages to other sites on the Internet
including the advertiser's site. Accordingly, any payments received by
CityNation Publishing shall be
returned to the advertiser.
Commission and Payment Terms: Advertising
Agencies recognized by the CityNation Publishing may receive a commission of 15% of gross, or otherwise specified in
the Order. If advertiser/agency is credit-approved, advertiser/agency agrees to remit
payment for advertising on or before the end of the month of which advertising is
published.
A 1.5% late charge will be assessed every
30 days past due. Agency discount applies to all charges. No other discounts or
commissions apply except as specifically stated in the Order.
Other conditions related to advertising
requirements and as may be specified in the E-Book Advertising Kit shall be
applicable to any related advertisement furnished by CityNation Publishing.
